A contract comprises of an offer and an acceptance , but if some unforseen event which is beyond the control of either party happens which makes the fulfilment of the contract impossible , then the contract is void.

Therefore the central argument in this part of the case, ( there will be many others) , is whether or not the contract had been fulfilled at the time of the crash. Nantes will say yes because they'd freed him to play for Cardiff - who may choose to argue that this was merely an arrangement and no actual services had yet been supplied at the material time.

To explain, if you signed a contract for sky TV you would be bound by it, but if they found they couldn't fit it due to some signal problem in your area or such then your contract would be void and you wouldn't owe them anything.

I take no position, by the way. I'm just explaining the potential legal argument as to whether the money is owed .
