The drinking ban on TfL is enforced under the terms and conditions of buying the ticket. It isn't a notifiable offence, therefore you cannot be arrested for it.

Yes, but Eaststand says it's breaking the law and other people get arrested for it, and I don't think he's ever confidently claimed something is right that turned out to be wrong.

Turns out the Hyde Park thing was the 420 gathering, that explains the vast number of empty nacho packets.

It's not an arrestable offence.

Yes it is, if the police want to arrest you for it they are entitled to.

On 1 June 2008, drinking on public transport in the capital became illegal under the supervision of former London mayor Boris Johnson.

The alcohol ban came into effect on the Tube, buses, Docklands Light Railway, tram services and stations.

In addition to consuming alcoholic beverages, it's also illegal to carry open containers of alcohol on the public transport network.

"I'm determined to improve the safety and security of public transport in London and create a better environment for the millions of Londoners who rely on it," Johnson said at the time.

Carrying alcohol in closed containers is permitted.

No it isn't.

You can prove this by quoting the law under which drinking on tube is a crime.

No it isn't, drinking in public isn't a licensable activity. You having wine at your park picnic isn't a crime.

I've covered this in detail on another thread, I'll dig it out if you want.

Drinking on TfL is prohibited under section 2.6 of the terms and conditions of buying a ticket. It isn't a criminal offence, TfL can't make up their own laws, it has no more legal force than heavy petting in the swimming pool.

Any TfL employee or British Transport Police officer can ask you to stop drinking on the Tube and tell you to leave if you don't. If you refuse to stop and refuse to leave TfL premises the Police officer can issue with a fixed plenty notice for causing disorder.

There is no general prohibition of drinking in public, it isn't a notifiable offence so they can't be arrested for it.

In some cases, local councils can set up protected spaces where drinking is prohibited and you may be issued with a fine.
